Terms of Use

1. Who we are

TenderTrust is a digital platform for transparent tender management, bidding, contracts, expenses, and civic engagement. The service is operated by the entity identified as the operator of TenderTrust ("we", "us", "our"). References to "you" mean the individual or organisation using the platform.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority in your country) and able to enter a binding contract. You are responsible for keeping your login credentials confidential and for all activity under your account.

• You must provide accurate registration information, including country, identity details where required, and role.
• One natural person should maintain only one personal account unless we approve otherwise in writing.
• Government, non-profit, for-profit publisher, and monitor accounts may be provisioned separately from public self-registration.

3. Roles and responsibilities

Features depend on your assigned role (for example contractor, citizen, government issuer, organisation publisher). You must use the platform only for lawful procurement-related purposes consistent with your role.

• Issuers are responsible for the accuracy of tender documents, evaluation, and award decisions.
• Contractors are responsible for the accuracy of bids, disclosures (including subcontractors and conflict of interest declarations where applicable), and compliance submissions.
• Citizens may participate in feedback mechanisms; abusive or defamatory content is prohibited.

4. Procurement content and decisions

TenderTrust provides tools to publish, discover, bid on, and manage procurement processes. We do not guarantee that any tender complies with national or organisational procurement law. Award, rejection, and contract decisions remain the responsibility of the relevant issuer unless we state otherwise in a separate written agreement.

5. Acceptable use

Your use must comply with our Acceptable Use Policy and applicable law. We may suspend or terminate access for breach, fraud, security risk, or harm to other users.

6. Intellectual property

We own the platform software, branding, and layout. You retain rights in content you upload (tender documents, bids, comments). You grant us a non-exclusive licence to host, display, and process that content solely to operate the service, including open-data publication where tenders or awards are marked public.

7. Privacy

Our Privacy Policy and Cookie Policy describe how we handle personal information and cookies. By using TenderTrust you acknowledge those policies.

8. Availability and changes

We aim for reliable service but do not guarantee uninterrupted access. We may modify features, suspend maintenance, or update these Terms. Material changes will be posted on the platform with an updated effective date. Continued use after changes constitutes acceptance where permitted by law.

9. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or business opportunity arising from use of the platform. Our aggregate liability for claims relating to the service is limited to the greater of (a) amounts you paid us in the twelve months before the claim or (b) one hundred United States dollars, except where law does not allow such limitation.

Nothing in these Terms excludes liability that cannot be excluded under the laws of South Africa, Zimbabwe, or your mandatory consumer protections.

10. Governing law and disputes

These Terms are governed by the laws of the country associated with your account at signup (South Africa or Zimbabwe), without regard to conflict-of-law rules. Courts in that country have non-exclusive jurisdiction, subject to any mandatory venue rules.
